I took my xbox into a place to get in it modded (it was a software) anyway i didnt have live for 3 months but am planning on getting, the guy stated microsoft wont be able to detect unless i play a game online that came out too early I played online before and months and never had trouble. Is it only the chips ones getting caught?

There is no way of knowing how they detect it as of yet. But it is happening to thousands of people whether or not they are playing games early online or not. Achievements are timestamped.
A modded console is not taken lightly by xbox. it is not the same as a modded controller, you actually modified xbox hardware and they consider it a federal offense.
It is not only the chipped ones being caught, it is anyone regardless of form of modification.
Well I really don’t think they can detect it because if so they would have caught so many people already. But in the updates they tend to use coding that may brick modded consoles, though I haven’t heard anyone state that happened yet. But beware if you get caught with a modded console, its 10 years in the slammer.
Within the past week Microsoft have been banning thousands of consoles with both software mods and mod chips
No one knows how they can tell yet but I wouldn’t play Live until an update is released for your firmware, even with an officially released back-up
ok your xbox should have a stealth chip in it which means that microsoft cant detect it but when they release updates they tend to try and find people with modded console which means that they may be able to see that you have modded your xbox cuz they manage to get through ur stealth chip.
